Appeal Court Gives Verdict on Suit Challenging Umahi's Emergence as Ebonyi South Senatorial Candidate

FCT, Abuja - David Umahi, the governor of Ebonyi has been affirmed as the validly elected candidate of the ruling All Progressives Congress (APC) for the Ebonyi South senatorial election in 2023.

The Court of Appeal in Abuja affirmed Umahi as the authentic candidate on Friday, September 30, TheCable reported.

The Federal High Court in Abakaliki, the Ebonyi state capital, had in July dismissed a suit filed by Governor Umahi, asking the court to recognise him as the APC candidate for the senatorial district.

The court subsequently ordered that a fresh primary election be conducted within 14 days.

Umahi eventually won the fresh primary election which was conducted in July 31.

A few weeks after the loss, Agom-Eze was expelled from the APC over alleged rebellious and unruly behaviour.

High court wrong for upholding Agom-Eze’s counter-affidavit - Appeal court

Delivering judgment in the appeal filed by the governor, the appeal court held that the high court was wrong when it upheld Agom-Eze’s counter-affidavit.

The appellate further held that the trial court erred when it failed to uphold the primary election of June 9 where Umahi was nominated as the APC senatorial candidate.

The court averred that the nomination was never challenged by anybody within 14 days as stipulated by section 285(9) of the 1999 constitution.

In another report, the factional governorship candidate of the Peoples Democratic Party (PDP) in Ogun state, Oladipupo Adebutu, has lost at the Court of Appeal in Abuja.

The appellate court set aside an earlier judgment of the Federal High Court given in Adebutu's favour in judgement on Friday, September 30.

Legit.ng gathered that the three-member panel of the Appeal Court held that Justice Taiwo Taiwo of the Federal High Court, Abuja (now retired) was wrong to have declined jurisdiction to entertain a suit by Jimi Adebisi Lawal.
