FCT, Abuja - The Federal High Court in Abuja has voided the nomination of two House of Representatives candidates for both All Progressives Congress (APC) and Peoples Democratic Party (PDP) in Jigawa and Zamfara states, respectively.

The court sacked Aminu Kanta as the APC candidate for Babura/Garki Federal Constituency of Jigawa state, The Nation reported.

In another judgement, the court sacked Sani Umar Dan Galadima as the PDP candidate for Kaura Namoda Bimin Magaji Federal Constituency of Zamfara state.

Why the PDP candidate in Zamfara was sacked

The presiding judge, Justice Inyang Ekwo, held that Galadima, a serving House of Reps member, was a member of the APC when he participated in the primary election held by the PDP.

Justice Ekwo held that Galadima, having not resigned, defected or cross-carpeted from the APC to PDP within the time stipulated by law, was not a lawful member of PDP and could not stand for any election on its platform.

He said Galadima ought to have relinquished his APC membership 30 days before the primary election of the PDP before he could qualify as a valid candidate for the PDP.

The judge, therefore, ordered that the PDP conduct a fresh primary to elect its candidate for the Kaura Namoda Bimin Magaji Federal Constituency of Zamfara state.

Aminu Kanta replaced by Isa Dogonyaro

In the other suit, Justice Emeka Nwite ordered that Alhaji Isa Dogonyaro be declared the APC lawful candidate for Babura/Garki Federal Constituency of Jigawa state.

The judge voided Kanta’s nomination on the grounds that he submitted a false name.

Justice Nwite held that Aminu Kanta gave false information in relation to his name when he claimed that his name is Aminu Kanta and that Anmed Mohammed is his former name in the affidavit in support of personal particulars submitted to the 1st respondent (INEC) as the candidate of the 2nd respondent (APC) for the seat of a member of the House of Representatives.

Justice Nwite proceeded to issue an order disqualifying Kanta from contesting for the seat and subsequently declared the plaintiff (Dongoyaro) as the candidate of the APC.

Court of Appeal sacks Akpabio as the APC candidate for Akwa Ibom Northwest

In a related development, the Abuja division of the Court of Appeal has set aside the judgment of the Federal High Court Abuja and removed Godswill Akpabio as the APC candidate for Akwa Ibom North West senatorial district.

A three-member panel of justices read by Justice Danlami Senchi held that Akpabio failed to file a proof of arguments within the time provided by the rules.

The panel further ruled that Akpabio, being a presidential aspirant of the APC, could not participate in the valid primary of the party held on May 27 and monitored by the Independent National Electoral Commission (INEC), which produced Udom Ekpoudom as a candidate.
