FG reportedly mulls dragging judge before NJC for granting Sowore bail

- The federal government is reportedly considering two actions in the wake of the court ruling granting Sowore bail

- Following the ruling, the FG, through DSS, is allegedly considering to appeal the judgement and reporting the presiding judge to the NJC

- According to an anonymous source, anyone standing trial for treasonable felony, which Sowore is accused of, is not entitled to bail

The federal government is allegedly contemplating reporting Justice Taiwo Taiwo to the National Judicial Council (NJC) over his ruling which granted bail to Omoyele Sowore, a report filed by The Nation claims.

Justice Taiwo on Tuesday, September 24, granted Sowore bail and dismissed the objection raised by the Department of State Security (DSS).

The judge ordered Sowore's release on the condition that his lawyer, Femi Falana (SAN), will produce him for arraignment whenever he is required.

The newspaper reports that the security agency on Friday night, September 27, resolved in meeting to appeal the judgement and also decided to petition the NJC on the issue.

A source who reportedly asked not to be named said that anyone standing trial for treasonable felony is not entitled to bail.

He said: ”Sowore’s bail is likely to bring trouble for that judge. A report has been prepared to report him to NJC in view of the fact that, as far as this country, it is known that a person charged treasonable felony has no bail option.

“So, the security and intelligence community in the country is shocked by the judgement.

“And there is a consensus that the judgement should not only be appealed but that the NJC should be petitioned about the conduct and abuse of power by the judge.”

Sowore who is the convener of RevolutionNow protest was arrested and kept in the DSS custody since August 3, 2019.

He was accused of calling for “revolution” through the group’s aborted protest which was fixed for September 5, 2019.

Meanwhile, Sowore has commenced a contempt suit against the director-general of the DSS,b Yusuf Bichi, for allegedly disobeying the order granting him bail.

His lawyers claimed that the DSS refused to comply with the court order even after his bail conditions had been met.

However, according to an earlier report by Legit.ng, the DSS claimed it had not received any valid court order for the bail of Sowore.

Peter Afunanya who is the spokesperson of the DSS described the security outfit as a law-abiding agency that has regards for the law of the country.

He said: “We have not received the court order. And his (Sowore’s) counsel is a very senior member of the bar and he knows the process to follow; this process has not been followed.

“Not until that is done, there is nothing we can do, we must due process in every we are doing, we expect his legal team too to follow due process”.
