Falana blows hot, says Saraki, Tambuwal, others defection unconstitutional

- Femi Falana has condemned the recent defection of the Senate president and other top politicians from APC to PDP

- Falana said the recent cross-carpeting by these political bigwigs is unconstitutional

- According to the senior lawyer, Nigeria's Constitution has prohibited cross-carpeting on the grounds of cheating or shortchanging the electorate

Human rights lawyer and senior advocate of Nigeria, Femi Falana, has described the defection of the Senate president, the governor of Sokoto state and all top politicians holding public offices as unconstitutional.

Falana faulting the politicians' defection from the All Progressives Congress (APC) to the Peoples Democratic Party (PDP) said as stipulated in the 1999 Constitution (as amended) there was no crisis in the APC to warrant their defection from the party to PDP.

Vanguard reports that the senior lawyer explained that the 1979 and 1999 constitutions have prohibited cross-carpeting on the grounds of cheating or shortchanging the electorate.

He said: “1979 and 1999 constitutions have prohibited cross-carpeting on the ground that you are cheating or shortchanging the electorate. And that was stated under section 68 1 (G) of the constitution.

“The only provision is that if your political party is in trouble and is fractionalized, major division, you can cross over, but not a division instigated for the purpose of exiting, no.

“So if you are elected on the platform of party A you don’t want that party again, you must go and seek fresh mandate on the platform of your new party," Falana noted.

Meanwhile, Legit.ng previously reported that PDP described the Senate president as the hero of Nigeria's democracy.

The national chairman of the PDP, Uche Secondus, also commended Saraki, Tambuwal and all politicians who have recently joined the PDP from the ruling party.

Secondus said that democracy is the huge beneficiary from the actions taken by the Senate president and Kwara state governor due to the on going political realignment which would help to deepen democracy in the country.
