Contrary to reports on various news platform that the director of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, will be arraigned in court today, December 29, checks by Legit.ng have shown that the reverse is the case.

On Wednesday, December 23, a Federal High Court presided by Justice Ahmed Mohammed remitted the case file of the federal republic of Nigeria versus Nnamdi Kanu to the chief judge of the court.

Mohammed’s action came after the accused person, Kanu, prior to hearing his plea objected the court’s attempt to preside over allegations against him by the state.

Kanu said he lacked confidence in the court and doubted if any ruling or decision made by the court will be obeyed by operatives of the State Security Service (SSS).

In his words: “Thank you very much my lordship, but my objection is that I will not receive a fair trial before this court. The information I got is that I will not receive a fair trial before this court.

“I will not sacrifice the due process of law because of speedy court process over the principle of natural process on the altar of speedy release. In other words, I would rather remain in detention than subject myself to a trial that I know amounts to perversion of justice.

“Your lordship, previous court rulings have been given by courts of competent jurisdiction in this country, Nigeria which were not carried out by the DSS.”

But going through the cause list on Tuesday, December 29, Legit.ng realized that Kanu’s case is not listed among cases to be heard by the vacation judge.

Also, the chief judge’s chamber was locked as at the time of filing this report.

A source who spoke to Legit.ng said: “It is obvious the case file is still with the chief judge and possibly have not been assigned to any judge.”

The source added that there is also the possibility that the reassignment of Kanu’s case will be done after the yuletide vacation.

Kanu’s lawyer Vincent Obetta who spoke to Legit.ng on Monday said: “What the judge (Ahmed Mohammed) said was that he would remit the file to the chief judge of the Federal High court for reassignment and that is where we are at the moment.”

“What happened in the court that day is the last thing that has happened,” he added.

Meanwhile, the Department of State Services for the first time since the incarceration of Nnamdi Kanu has given details of his arrest.

The DSS noted that if not for the expertise of its men, the director of Radio Bifra could have slipped away from the watchful eyes of the service that had been on his trail.
