EndSARS: Police drop suit seeking to thwart judicial panels’ probe

- On second thought, the Nigerian Police Force has withdrawn its suit against the judicial panels

- The NPF filed a notice of discontinuance of the suit on Friday, December 4

- This came after IGP Mohammed Adamu ordered a probe of the suit filed by a legal representative of the Force

The initial suit filed by the Nigerian Police Force (NPF) challenging the legality of the judicial panel set up by state governors to hear cases of police brutality was on Friday, December 4, withdrawn.

The notice of discontinuance was filed by a counsel to the police, Festus Ibude. The force indicated its intention to withdraw the suit against all the defendants, The Cable reports.

The application of the NPF read:

“Take notice that the plaintiff herein intends to and doth hereby wholly withdraws its suit against all the defendants.”

Earlier, the NPF distanced itself from a suit that challenged the legality of judicial panels set up by state governors to probe cases of brutality against citizens by members of the disbanded Special Anti-Robbery Squad (SARS).

The suit was filed by a legal representative of the NPF, O.M. Atoyebi, who argued that the establishment of the panels was unconstitutional, since, according to him, it violated the constitution and section 21 of the tribunals of inquiry act.

However, Inspector-General of Police (IGP) Mohammed Adamu kicked against this move, stressing that the force will stop at nothing to ensure that victims of police brutality get justice eventually.

More than that, IGP in a statement released on Thursday, December 3, ordered a probe into the said suit filed by Atoyebi.

The police IG maintained that the Force is committed to fulfilling all its obligations with regards to the disbandment of SARS, the ongoing judicial panels across the states, and all other police reform. The statement signed by the police spokesman, Frank Mba, read partly:

"Meanwhile, the Force Legal Officer has been queried and may face further sanctions if found guilty of dereliction of duty."
