N90bn scandal: PDP tells Osinbajo to resign, says there's no waiver of immunity in constitution

- PDP has reacted over VP Yemi Osinbajo's threat to waive his immunity

- Osinbajo had on Thursday, September 26, said that he would waive his immunity to allow thorough investigation over alleged corruption against him

- The party, however, asked the vice president to resign his position to allow unbiased investigation

Vice President Yemi Osinbajo has been asked by the Peoples Democratic Party (PDP) to resign his position if he really meant that he would waive his immunity to allow thorough investigation of alleged corruption against him.

Legit.ng reports that the national publicity secretary of the party, Kola Ologbondiyan, said in a statement issued on Thursday, September 26, that Osinbajo should make good his threats to set aside his constitutional immunity by immediately resigning his office to face the corruption allegations in which his name was mentioned.

The party said since Osinbajo has announced his readiness to renounce his constitutional immunity in the face of corruption allegations, he should do the needful by resigning and vacating the office as there is no provision for waiver of immunity in Nigeria's constitution.

The PDP holds that immunity under section 308 of the 1999 constitution (as amended) is conferred on an official by virtue of his/her election into an office within a duration and cannot be waived by any means other than resignation.

The statement read: "It is instructive to state that Section 308 confers immunity to the holder of the office during his period in office. There is no provision for waiver while the holder is still in office.

"Vice President Osinbajo should know that it is settled that section 308 can only be set aside by vacating the office. It is not a jacket to be put on or dropped at will. Significantly, our party invites the vice president to note that his pronouncement has set off a process, which is expected to terminate in his resignation."

Meanwhile, Legit.ng had previously reported that Osinbajo on Wednesday, September 25, in a tweet said that he was ready to forgo his immunity to allow proper investigation of falsehood and libel against him.

The vice president is also planning to take legal action against Timi Frank and Katch Ononuju who have been at the forefront of the falsehood claims.
