According to the lawyer known on TikTok as @de_monarch1, the laws do not recognise paternity fraud as a crime.

She said it is possible for a woman to pin a baby on a man and conveniently get away with it.

The lawyer said this could happen because paternity fraud is not a crime on its own.

She said women who commit paternity fraud may not go to jail since the crime is not known to the law in Nigeria.

Her words:

"Paternity fraud is NOT a crime in Nigeria. A woman can knowingly pin a child on the wrong man and face zero jail time."

The lawyer advised that any man who is in doubt about his child's paternity could do a DNA test to establish the truth.

Is paternity fraud a crime in Nigeria?

She said the only remedy in law is for the man to commence a civil suit against his spouse if the child is not his.

Her words:

"For the umpteenth time, paternity fraud is not a crime in Nigeria. The most you can do is to commence a civil lawsuit against your spouse. However, it is not a crime in Nigeria. Unfortunately, it is so. So if you have doubts as to the paternity of your child, for your own good, conduct a paternity test. You do not have to be loud about it. You can carry out a test in secret."

Her views are in line with those of M.O.Idam, Esq, another lawyer who published an article on the topic.

However, M.O.Idam, Esq, said men affected by paternity fraud are not helpless. He also called for new legislation to cover the issue.

He wrote:

"Victims of paternity fraud are not helpless except they choose to. While gender-based violence of any kind must be discouraged, paternity fraud should not be treated as an orphan. By this piece, I recommend a special legislation to be passed by the National Assembly purposely to address issues of paternity fraud and matters associated to it, in order to curb the social vice which is gradually gaining acceptance in Nigerian society."
