The governor of Ondo state, Oluwarotimi Akeredolu, has again recorded a victory in a case instituted against him over his emergence as the candidate of the All Progressives Congres (APC) during the governorship election in the state.

The Nation reports that a Federal High Court in Abuja on Wednesday, December 15, dismissed the suit, saying it was statute-barred.

Legit.ng gathered that the plaintiff, Nathaniel Adojutelegan, who participated in the party's primary but lost, had challenged the adoption of the indirect mode of primary for the selection of a candidate for the election.

In a judgment, Justice Okon Abang upheld the arguments by the APC and Akeredolu that the suit was filed outside the 14 days allowed under section 285(9) of the constitution for the institution of pre-election cases.

The judge, who also held that part of the issues raised in the suit was not justiciable, being pre-primary matters, relating to the internal affairs of the APC, proceeded to dismiss the suit.

Meanwhile, Legit.ng had previously reported that the candidate of the Peoples Democratic Party (PDP) in the Ondo election, Eyitayo Jegede, revealed his reason for challenging Governor Akeredolu at the tribunal.

According to him, the governor was not validly nominated by the APC for the October 10 election.
