Please honour NASS invitation, Falana tells Buhari

- Femi Falana has pleaded with President Buhari not to embarrass himself

- Falana was speaking with respect to the NASS invitation to the president on the issue of insecurity

- Before this, AGF Abubakar Malami had stated that no part of the Nigerian constitution obligates the president to honour the invitation

Contrary to the argument of Attorney-General of the Federation (AGF) Abubakar Malami, Femi Falana (SAN) has cited sections of the constitution that empowers the National Assembly to summon President Muhammadu Buhari.

Falana, in a statement that came as a reaction to Malami's position, insisted that President Buhari is under moral and legal obligation to honour NASS' invitation.

The renowned Nigerian lawyer went on to say the president should not embarrass himself by disregarding the invitation, The Cable reports.

His words:

“On his own part, the honourable attorney-general of the federation has questioned the constitutional power of the national assembly to invite the President on the grounds that as the Commander-in-Chief of the armed forces he cannot be compelled to disclose operational details of the defence of the country.
“With respect, the president is under a moral and legal obligation to honour the invitation."

Falana noted that the president had accepted the invitation and it would be embarrassing to now turn around and refuse to honour it.

He added that sections 88 and 89 of the constitution of NASS is empowered to summon any public officer including the president on issues over which it can make laws on behalf of the country.

The senior lawyer elaborated further that under these sections, the legislature is given the powers to unearth fraud, "inefficiency or waste in the execution or administration of funds appropriated by it.”

Meanwhile, Buhari is billed to address a joint session of the National Assembly on Thursday, December 10, where he is expected to tell the country the steps he was taking to stop the continuous killings, kidnapping and other forms of lawlessness.

This followed an invitation from the House of Reps for the president to appear on the floor to explain why security issues were getting worse.
