Senatorial by-elections: Court clears way for Bayelsa APC candidates to contest

- The APC in Bayelsa has been cleared to contest the forthcoming senatorial by-elections in the state

- This is as the appeal court granted the motion for the stay of execution on the earlier judgment which disqualified the party's candidate in Bayelsa West

- Also, the suit seeking the disqualification of the party's candidate in Bayelsa Central has been struck out

The candidates of the All Progressives Congress (APC) in the forthcoming senatorial by-elections in Bayelsa state have been cleared by the court to participate in the polls, The Sun reports.

Recall that the Federal High Court in Yenagoa had earlier disqualified the APC's candidate in Bayelsa West, Peremobowei Ebebi, from contesting over allegations of fraud.

Consequently, the Independent National Electoral Commission (INEC) relying on the judgment struck the name of the APC and its candidates from the list of those to contest.

However, a special panel of the Court of Appeal sitting in Port Harcourt, Rivers state on Wednesday, December 2, stayed the execution of the judgment until the substantive suit is held.

The panel held that “Ebebi remains innocent of fraud", adding that "there was no finding by the trial court that he committed fraud”.

The court thereby granted the motion for stay of execution of the previous judgment which effectively paved the way for Ebebi to contest the election.

Similarly, the APC's candidate in Bayelsa Central, Chief Abel Ebifemowei, will also be contesting as the Federal High Court in Yenagoa struck out the case seeking to disqualify him from the election.

Meanwhile, the Lagos state chapter of the APC has reacted to the comment made by the Peoples Democratic Party (PDP) that its candidates for the Lagos East senatorial and House of Assembly by-elections would emerge victorious.

In a statement issued on Monday, November 30, by the spokesman of APC in Lagos state, Seye Oladejo and seen by Legit.ng, the party described PDP leaders as jesters and wishful thinkers.

Oladejo said the PDP's forecast to win the election could only happen in their dream, challenging the party to name the organizers of the purported poll.
