Appeal court affirms Ifeanyi Ubah as senator-elect in Anambra

- A Federal Court of Appeal has affirmed the election of Ifeanyi Ubah

- The decision to affirm the election was a unanimous one

- According to the appellate court, the lower court had no jurisdiction to have entertained the matter

Dr Ifeanyi Ubah of the Young Progressive Party has received the backing of the court as the senator representing Anambra South after the Court of Appeal in Abuja affirmed his election.

Recall that a Federal Capital Territory (FCT) high court in Kubwa, Abuja, had recently nullified his election.

Justice Bello Kawu ordered the INEC to withdraw his certificate and issue a fresh certificate to the candidate of the Peoples Democratic Party (PDP), Obinna Uzoh.

Uzoh was the candidate that came second in the election.

The three member-panel in a unanimous decision held that the lower court had no jurisdiction to have entertained the matter.

Justice Stephen Adah in the lead judgement said the appeal of the appellant has merit and it is hereby allowed.

Legit.ng had reported that Ifeanyi Ubah is not backing down after he was sacked.

Ubah, on Monday, March 9, took his case to the Court of Appeal, calling on it to re-instate him as the rightful senator in place of Obinna Uzoh of the Peoples Democratic Party (PDP) who took over his office by court order, Channels TV reports.

Ubah had been sacked from his seat by Federal Capital Territory (FCT) high court in Bwari, Abuja earlier in 2020.

Earlier, Legit.ng reported that barely ten days after he was sacked by an Abuja high court over alleged certificate forgery, Ubah's certificate had been confirmed by the National Examination Council (NECO).

Legit.ng gathered that the embattled senator on his Facebook page on Monday, January 27, said the examination body confirmed the certificate he submitted to INEC as original and authentic.

According to him, in a letter with the particulars as follows: NECO/R/LGS/20/003, dated January 23, 2020 and addressed to Human Rights Writers Association Of Nigeria (HURIWA), Senator Ubah and YPP, the examination body released Senator Ubah's result details and cleared the air about the statement of result and NECO certificate.
