Asking for review of Supreme Court verdicts unconstitutional - Bulkachuwa

Justice Zainab Adamu Bulkachuwa who recently retired from her position as the president of the Court of Appeal has waded in on the recent request by Nigeria's major political parties asking the Supreme Court to review its judgements.

Leadership newspaper reports that the retired senior judge said the move which is championed by senior lawyers in the country is unconstitutional.

Bulkachuwa said the development is a threat to Nigeria's judiciary sector. She reiterated that asking the “Supreme Court to review its judgements is unconstitutional. It’s not the law.”

The retired jurist said anyone with a contrary standpoint should indicate the section of the Nigerian law that backs up the review calls.

The Peoples Democratic Party (PDP) during the hearing of its petition against the election of President Muhammadu Buhari asked Justice Bulkachuwa to recuse herself from the panel of judges.

The party said the retired judge's husband is a chieftain of the All Progressives Congress (APC) and may be biased in her judgement.

Reacting to the development, Bulkachuwa said the PDP's application asking her to recuse herself was misplaced.

She said she tried tas much as possible to the upright in her judicial conduct knowing that one day she will give account to God.

The retired judge said she had even forgotten her husband was a politician when the issue of the presidential election petitions panel came up.

She said she decided to head the panel because she believed as the then president of the Court of Appeal, she would have been the best person to handle the case.

Bulkachuwa said she would have done justice to the case irrespective of her husband's political affiliation.

She said she, however, decided to recuse herself the PDP had already raised doubt and she would not be seen as being impartial no matter what she did or said.

Meanwhile, following the dismissal of the application filed by the former governor of Imo state, Emeka Ihedioha, by the Supreme Court, the Peoples Democratic Party (PDP) has faulted the decision of the apex court.

Legit.ng reports that the party through its national publicity secretary, Kola Ologbondiyan, described the verdict as a disconcerting endorsement of electoral fraud, adding that the decision places a huge burden on the court and the justices.
