Reverse your judgment on Buhari’s election - HDP tells S/Court

- The Supreme Court has been asked by the Hope Democratic Party and its 2019 presidential candidate, Chief Ambrose Owuru, to reverse itself in the judgment dismissing the appeal filed against President Buhari’s election

- The HDP claimed that the October 3 judgment delivered in favour of the president was invalid and unconstitutional, as it was based on technicalities

- According to the appellants, the dismissal of the appeal on technical grounds was without compliance with the mandatory procedure

The Supreme Court has been asked by the Hope Democratic Party (HDP) and its candidate in the February 23 presidential election, Chief Ambrose Owuru, to reverse itself in the judgment dismissing the appeal filed against President Muhammadu Buhari’s election.

The HDP and Owuru’s appeal against the Presidential Election Petition Tribunal (PEPT)’s verdict which dismissed their petition for lacking in merit, was struck out by the apex court on Thursday, October 3, ThisDay reports.

Legit.ng gathers that in a ruling on a preliminary objection filed by respondents in the appeal, the Supreme Court held that the appellants engaged in gross abuse of court processes by filing two notices of appeal, contrary to the provisions of the law.

The HDP claimed that the October 3 judgment delivered in favour of the president was invalid and unconstitutional, as it was based on technicalities.

The appellants implored the court to restore their appeal for fresh hearing on merit.

According to the appellants, in the motion filed by Chukwunonyerem Njoku, the dismissal of the appeal on technical grounds was without compliance with the mandatory procedure.

The appellants also noted that by virtue of Order 8 upon which the dismissal was based, an appellant whose appeal has been dismissed under the rule may apply by notice of motion that the appeal be restored.

Recall that Legit.ng previously reported that the suit filed by the presidential candidate of the HDP, Chief Ambrose Owuru, against the election of President Muhammadu Buhari was annulled by the Supreme Court in Abuja.

The verdict, issued by Justice Mary Peter-Odili, held that the HDP made a gross error in filing two notices of appeal which contravened the law, a move described as capable of misleading the court.

The appeal against the HDP's suit was contested by Prince Lateef Fagbemi, SAN, which was upheld by the apex court.
