Court of Appeal refuses to sack Senator Bulkachuwa

- The court of Appeal in Abuja affirmed Adamu Bulkachuwa as the rightful senator representing Bauchi North

- This was following Alhaji Usman Tuggar's case claiming he was the rightful APC candidate

- Tuggar claimed Bulkachuwa was handpicked by the party

Senator Adamu Bulkachuwa who is the lawmaker representing Bauchi North has triumphed at the Court of Appeal in Abuja after the court refused to sack him.

The Sun reports that Alhaji Usman Tuggar who is the appellant insisted he was the rightful candidate of the All Progressives Congress (APC) after the primary election and thus deserves to be the lawmaker.

He said: “I won the primary election of the All Progressives Congress for the Bauchi North senatorial district election with over 54,000 votes cast at the said primary election.

Following Bulkachuwa’s victory at the court, Tuggar vowed to take the matter to the Supreme Court. He claimed the lawmaker was allegedly handpicked by the leadership of the party to replace the supposed winner of the primary election that held on October 3, 2018.

In his suit, Tuggar prayed the Abuja division of the Federal High Court to hold that Bulkachwa was illegally nominated to vie for the senatorial seat.

The Federal High Court, in its judgement delivered on April 18, dismissed the suit, saying “it was statute barred since the plaintiff failed to institute the action within 14 days after APC forwarded Bulkachuwa’s name to INEC.”

Tuggar subsequently approached the Court of Appeal to set aside the decision of the trial court, but in a unanimous judgement of a three-man panel of the appellate court led by Justice Akomolafe Wilson, the high court judgement was upheld.

The judge said: “Considering when appellant became aware of his exclusion as a validly nominated candidate, the suit had become statute barred. Any suit filed outside the time frame is statute barred.”

Meanwhile, the president of the Court of Appeal, Justice Zainab Bulkachuwa withdrew from the presidential election petition tribunal due to allegation from Atiku Abubakar and the Peoples Democratic Party (PDP) that her husband’s position as a senator-elect of the All Progressives Congress (APC) would make her bias.
