The Presidential Election Petition Tribunal on Monday, June 10, dismissed the petition of the Coalition for Change (C4C) against the victory of President Muhammadu Buhari in the February 23 presidential election.
Channels TV reports that the counsel representing Buhari and the All Progressives Congress (APC), Wole Olanipekun and Lateef Fagbemi, informed the court that their clients were yet to be served with a copy of the petition.
Olanipekun said at the last adjourned date, the panel had granted an application for substituted service but that up till Monday morning, the petitioners were yet to serve the processes on the first respondent.
The counsel representing C4C, Obed Agwu, informed the tribunal that an application for the withdrawal of their petition against the election of the president was filed in court but was yet to be served on the respondents.
Following the non-objection of the application by other parties involved in the matter, the five-member panel led by Mohammed Garba accordingly granted the application and dismissed the suit.
Earlier, Legit.ng reported that the president of the Court of Appeal, Zainab Bulkachuwa, has been replaced at the presidential election petition tribunal by Justice M.L. Garba.
Justice Garba is the presiding judge of the Lagos division of the Court of Appeal. Garba appeared on the five-man panel for the first time on Monday, June 9. Bulkachuwa recused herself from the panel.
Bulkachuwa withdrew from the presidential election petition tribunal after the PDP and its presidential candidate, Atiku Abubakar, asked her to recuse herself because she is married to a senator-elect of the APC.
