Abuja court sacks APC rep-elect Abdulrauf Abdulkadir

- Abdulrauf Moddibbo, an elected member of House of Representatives for Adamawa state, has been dismissed by a Federal High Court in Abuja

- Moddibbo was accused of falsifying his age and not being eligible to contest the APC primaries

- The APC and INEC have been ordered to recognise Mustapha Usman, who came second in the party primary, as the winner the last National Assembly election

The All Progressives Congress on Friday, May 3, suffered a setback as Federal High Court in Abuja dismissed its elected member of House of Representatives for Adamawa state, Abdulrauf Abdulkadir Moddibbo, over false information to the Independent National Electoral Commission (INEC).

Justice Inyang Ekwo ordered the APC and INEC to recognise Mustapha Usman, who came second in the party primary of October 7, 2018, as the winner of the February 23 National Assembly election for Yola South, Yola North, and Girei Federal Constituency of the state.

The court held that Usman has established the offence of forgery of Modibbo’s First School Leaving Certificate and his participating in partisan politics while serving as a member of the National Youth Service Corps (NYSC) which violates Paragraph 9 of Section 4 of the NYSC Act.

The court declared: “That going by the depositions of the 1st defendant contained in the various affidavits and documents deposed to or signed by the 1st defendant, Abdulrauf Abdulkadir Modibbo; some of which he submitted to the 3rd defendant, INEC, as contained in FORMS CF001, CF002 and the affidavit thereto, the 1st defendant’s personal information as to his actual age and primary school certificate therein is false and forged.

“The 1st defendant Abdulrauf Abdulkadir Modibbo, is not qualified to have been nominated as the 2nd defendant’s All Progressive Congress (Party) candidate for the Yola South/Yola North/Girei Federal Constituency of Adamawa state in the 2019 general elections."

In addition, Justice Ekwo declared: “That in view of the disqualification of the 1st defendant Abdulrauf Abdulkadir Modibbo, the plaintiff Mustapha Usman who polled the 2nd highest votes in the primary election of the 2nd defendant, APC for the Yola South/Yola North/Girei Federal Constituency of Adamawa state which held on the 7th day of October 2018 is the lawful winner of the primary election and therefore the candidate of the APC for the Yola South/Yola North/Girei Federal Constituency of Adamawa State for the 2019 general elections."

Legit.ng previously reported that a Federal High Court sitting in Yola, ordered the APC rep-elect for the Yola South/Yola North/Girei federal constituency, Modibbo, to vacate his seat.

The court ordered the rep-elect to vacate his seat for the candidate of the Peoples Democratic Party (PDP), Jaafaru Sulaiman Ribadu.

Ribadu was the runner up in the Saturday, February 23 House of Representatives election for the Yola South/Yola North/Girei federal constituency.
