Legit.ng had reported that the election tribunal judgment on Osun 2018 governorship election ruled in favour of Senator Adeleke.
The three-member bench of the tribunal led by Justice Ibrahim Sirajo delivered its judgment at the Federal High Court, Apo, Abuja on Friday, March 22.
The petition was filed by the PDP and its governorship candidate, Adeleke, challenging the victory of Governor Gboyega Oyetola of the All Progressives Congress (APC) in the guber polls held in September 2018.
However, the judgement in favour of Senator Adeleke was not unanimous. Justice Sirajo who is the chairman of the tribunal dismissed the petition by the PDP and Senator Adeleke.
The tribunal chairman delivered a dissenting judgement, saying the petitioners failed to prove their claims and ruled that where it is established that there is non compliance, the tribunal does not have “the powers to subtract the votes of the non compliance and declare a candidate winner.”
He added that "under Section 140(3) of the Electoral Act, where substantial non compliance is proved, the tribunal can only order a supplementary or fresh election.”
Meanwhile, Governor Oyetola of Osun has also reacted, saying the judgment of the election petition tribunal that sacked him had been put on appeal.
Oyetola, in a statement by the Secretary to the State Government, Wole Oyebamiji, in Osogbo said justice will prevail.
