The electoral commission in a statement issued on Friday, February 22, stated that its decision to to allow APC participate in the elections follows a ruling of the Court of Appeal which set aside the decision of the Federal High Court in Abuja which had earlier stated that the APC having failed to hold primaries could not participate in the elections.

INEC stated that following the ruling of the Court of Appeal, it would adhere to ruling of the Zamfara State High which ruled that the APC could participate in the elections.

The commission stated that it has restored the APC to the ballot box in the National Assembly, governorship and state assembly elections scheduled for February 23, and March 9.

Meanwhile, a senior lawyer, Mike Ozekhome has argued that the ruling of the Court of Appeal sitting in Abuja on Thursday, February 21, was twisted by some elements to give the impression that the ruling All Progressives Congress (APC) can now field candidates in Zamfara state, Chief Mike Ozekhome has said.

Chief Ozekhome, who is the counsel to Senator Kabiru Marafa and his group, said the appeal court ruling did not ask the Independent National Electoral Commission (INEC) to allow the APC field candidates as was earlier reported.

Instead, the senior lawyer said the court actually dismissed the appeal filed by the APC challenging the judgement of Justice Ijeoma Ojukwu of a Federal High court which affirmed INEC’s position that the party cannot field candidates.
