Breaking: Supreme Court strikes out Senate’s suit over CJN’s suspension

The Supreme Court has struck out the suit filed by the Senate, challenging President Muhammadu Buhari’s suspension of the former Chief Justice of Nigeria Justice Walter Onnoghen.

The Nation reports that the lawyer to the Senate, Paul Erokoro (SAN) told the court, when the case was called on Tuesday morning, February 5, that he filed a notice of discontinuance on Monday, February 4, in the suit marked: SC76/2019.

Legit.ng gathered that the Senate's lawyer was silent on why the plaintiff chose to discontinue Onnoghen's case.

The lawyer to President Buhari, Maimuna Lami Shiro, who led Tijani Gazali, did not object to the plaintiff’s decision to withdraw the case, following which the court struck out the suit.

Meanwhile, Legit.ng had previously reported that the Nigerian Senate discontinued a case it filed at the Supreme Court challenging the suspension of Chief Justice Walter Onnoghen.

Yusuph Olaniyonu, the media aide to the Senate president, Bukola Saraki, in a statement on Monday, February 4, said the decision follows the intervention of the NJC on the issue.

"The Senate has therefore decided to discontinue the case it filed in the Supreme Court. It should be noted that the case has been slated for hearing tomorrow," the statement had said.
