Supreme Court strikes out applications by Benue sacked legislator seeking to reclaim seat

- Two applications by a sacked Benue legislator, Benjamin Nungwa, to reclaim his seat, have been struck out by the Supreme Court

- Recall that Nungwa was sacked as representative of Kwande West state constituency by an Appeal Court

- The court upheld the arguments of respondent’s counsel that all applications were incompetent and could not stand

The Supreme Court on Thursday, December 6, struck out two applications by a sacked Benue legislator, Benjamin Nungwa, seeking to reclaim his seat in the Benue House of Assembly on grounds of incompetence.

In one of the motions Nungwa filed, the lawmaker sought to set aside an Appeal Court judgment that sacked him as the Kwande West state constituency representative, NAN reports.

Legit.ng gathers that the second application, also struck out by the court, was a motion seeking leave of court to appeal the judgment that sacked him as a lawmaker in the state legislature.

The apex court, presided over by Justice Olabode Rhodes-Vivo, upheld the arguments of respondent’s counsel, Douglas Pepe, that all applications were incompetent and could not stand in court.

The judge agreed that the particulars of the judgment the appellant sought to appeal were not contained in the application before the court. He, therefore, struck them out for being incompetent.

Pepe, had in his submissions before the apex court averred that the application seeking stay of judgment was already before an appeal court in Makurdi, while the other seeking leave to appeal the appeal court judgment that sacked him, was filed late.

Responding to the arguments, appellants’ counsel, LA Izabi, insisted that the application for stay of judgment was not an abuse of court process, arguing that he had already withdrawn that of the Appeal Court.

Legit.ng previously reported that after three years of legal battle over a legislative seat in the Benue state House of Assembly, the Appeal Court in Makurdi on Friday, November 2, gave judgment in favour of Joseph Boko and ordered the immediate sack of Benjamin Nungwa, the occupant of the seat.

Both Boko and Nungwa contested the All Progressives Congress primary of Kwande West legislative seat in the state House of assembly in April 2015, which was won by Boko.

Dissatisfied with the conduct of the primary, Nungwa, sent a petition concerning the outcome of the primary to the APC national secretariat for arbitration.

An Arbitration Panel was set up by the national working committee of the party to resolve the disputed primary election.
