The high court in Owerri has declared as invalid and of no legal effect, the impeachment of the deputy governor of Imo state, Eze Madumere.
Punch reports that the presiding judge, Justice Benjamin Iheaka, made the declaration on Tuesday, September 25.
Legit.ng gathers that there was jubilation within the premises of the court after Justice Iheaka made the declaration.
The chief judge of the state, Paschal Nnadi, and the attorney general of the state, Militus Nlemadim, were flayed by the judge for not adhering to the provision of the section 188(5) of the 1999 constitution as amended in the impeachment of Madumere on July 31, 2018.
According to Justice Iheaka, Nnadi constituted the seven-man panel to investigate the allegations of gross misconduct by Madumere by the state House of Assembly outside the seven days lifeline as provided by the constitution.
Legit.ng previously reported that the deputy governor of Imo, Eze Madumere, was in the afternoon of Monday, July 30, impeached by the state’s House of Assembly. It was learnt that 19 out of the 27 members took the decision to get him parking.
The speaker of the House, Acho Ihim, announced that the impeachment was as a result of the outcome of a report by a seven-man panel constituted by the chief judge of the state to investigate allegations of gross misconduct against Madumere.
Part of the allegations included his alleged absence without reasons for a period of three months and a failure to perform constitutional duties like attending state executive and state security council meetings.
Meanwhile, Legit.ng previously reported that policemen attached to the Imo state Government House in Owerri, on Thursday, August 2, unlocked the office of the impeached deputy governor of the state, Eze Madumere.
According to report, the unlocking of Madumere’s office came 24 hours after his office was locked by the police.
