Court dismisses Orji Kalu’s no-case submission in alleged N3.2bn fraud

A chieftain of the All Progressives Congress (APC) and former governor of Abia state, Orji Uzor Kalu, has lost a no-case submission he reportedly filed before Justice Muhammed Idris of the Federal High Court sitting in Ikoyi, Lagos.

Premium Times reports that Kalu lost his bid to stop his trial over an alleged N3.2 billion fraud.

The report said Kalu, his former commissioner for finance and account, Jones Udeogu, and a company, Slok Nigeria Limited, are being prosecuted by the Economic and Financial Crimes Commission (EFCC).

They are facing an amended 39-count charge bordering on money laundering to the tune of N3.2 billion.

The report added that through its consel, Rotimi Jacobs, the EFCC earlier closed its case against the defendants after taking evidence by a prosecution witness, Chidi Chukwuka, who is the deputy director of the Nigeria Deposit Insurance Corporation (NDIC).

“During the May 11, 2018 proceedings, the prosecution counsel had also moved an oral application to amend the charge against the defendants in view of the evidence given so far.

“However, the defence led by Awa Kalu, had, on May 28 filed a no-case submission on behalf of their clients, which they subsequently adopted as their written address,” the report said.

Justice Idris, in his ruling on the no case-submission, said the prosecution had established a prima facie case against the defendants based on the evidence against the defendants.

“You have explanations to make,” the judge said.

Justice Idris then adjourned the case to September 10, 2018, for the defendants to open their defence after the court was told that the lead counsel had written a notification that he would be travelling abroad for surgery. earlier reported that Orji Uzor Kalu reacted to the report that he was plotting to dump the All Progressives Congress (APC) for the Peoples Democratic Party (PDP), describing the report as false.
