Supreme Court affirms earlier rulings against Dasuki

- The appeal filed by the ex-national security adviser, Colonel Dasuki Sambo, challenging his continued detention, has been struck out by the Supreme Court

- The apex court held that the EFCC cannot be held responsible for his detention

- It added that bail granted him had already been obeyed after being implemented by the controller of prison, Kuje

The Supreme Court has held that the detention of the former national security adviser, Colonel Sambo Dasuki, was not at the instance of the Economic and Financial Crimes Commission (EFCC) that put him on trial, Premium Times reports.

Legit.ng gathered that Dasuki, who is currently facing trial for allegedly misappropriating N32 billion meant for arms under the administration of ex-president, Goodluck Jonathan, was told by the apex court that the bail granted him had been obeyed after being implemented by the controller of prison, Kuje, on December 29, 2015.

In challenging his continued detention, Dasuki had filed an appeal, praying for suspension of his trial pending the time the bail orders were obeyed by government, which Justice Ajembi Eko ruled against.

Justice Eko said that the EFCC cannot be held responsible for the continued detention of the ex-NSA since the detention was carried out by the State Security Service (SSS).

Justice Eko said since the bail order was implemented by the prison controller, it had been obeyed as far as the charges against him at the FCT High Court was concerned, adding that the appeal brought by Dasuki lacked merit and constituted abuse of court process and therefore dismissed it.

Dasuki and the EFCC were ordered by the court to go back to the FCT High Court to continue with the trial in the charges brought against him by the anti-graft agency.

Meanwhile, Legit.ng previously reported that the Supreme Court on Monday, December 6, 2017, fixed March 2 for judgment on an appeal by Sambo Dasuki challenging his alleged indefinite detention.

The panel of five Justices, led by Dattijo Mohammed, gave the date after counsels to the parties in the case adopted their addresses.

The ex-NSA had on June 15, 2016 at the Court of Appeal in Abuja, lost his bid to enforce his freedom after securing bails on all the charges against him.
